KC Living Limited is the data controller for the personal information described in this notice.

What this notice covers

It covers everyone whose information we handle: people who contact us through this website, sellers and their families or representatives, and anyone whose belongings we handle as part of a clearance.

Information we collect

If you contact us. Your name, email address, telephone number if you choose to give one, and whatever you write in your message.

If you are selling an apartment to us. Your contact details and those of anyone acting for you; the address and details of the property; title, lease and management pack information; details of any mortgage, equity release or lifetime mortgage secured on it; and, where relevant, evidence of authority to sell — a grant of probate, a lasting power of attorney, or a Court of Protection deputyship order. We are also required by law to carry out identity and anti-money-laundering checks, which means collecting identity documents and, in some cases, evidence of the source of funds.

If we carry out a clearance. Access arrangements, instructions from the family about what to keep, return or donate, and incidental information contained in documents or belongings we encounter. We do not read, copy or retain personal papers beyond what is needed to return them to you safely.

Special category and criminal offence data

Sometimes health information reaches us — a move prompted by a hospital stay, a care need affecting the timing of a sale, or an adjustment you need to a property. We collect it only where you volunteer it or it is necessary, use it only for the purpose you gave it to us for, and rely on your explicit consent or, where applicable, the substantial public interest ground for safeguarding adults at risk. Where anti-money-laundering checks return information about criminal convictions, we process it because the law requires us to.

Why we use it, and our lawful basis

• To answer your enquiry. Our legitimate interest in responding to people who contact us.
• To value a property and make an offer. Steps taken at your request before entering into a contract.
• To complete a purchase. Performance of the contract between us.
• To carry out identity and anti-money-laundering checks. Compliance with our legal obligations.
• To transfer utility and council tax accounts so that nothing is left in a relative’s name after completion. Our legitimate interest, and yours, in closing accounts properly.
• To keep records, resolve disputes and meet tax and accounting duties. Our legal obligations and legitimate interests.

We do not send marketing emails. If that ever changes we will ask for your consent first, and you will be able to withdraw it at any time.

Who we share it with

Only where it is needed to do what you have asked, or where the law requires it: solicitors and conveyancers acting on the transaction; the freeholder or managing agent, for the leasehold management pack and to register a transfer; surveyors and valuers; utility companies and the local authority, to transfer accounts; HM Land Registry; our accountants, insurers and professional advisers; and law enforcement or regulators where we are legally obliged to.

We also use two service providers to run this site and our email: Netlify, who host the website and process enquiry form submissions, and IONOS, who host our email. Both act on our instructions as processors under a written contract.

We never sell your personal information or share it for anyone else’s marketing.

Where your information is held

Our email is hosted in the European Economic Area. Netlify processes form submissions in the United States, under the UK Extension to the EU–US Data Privacy Framework together with the International Data Transfer Addendum, which provide the safeguards required by UK data protection law.

Cookies and analytics

This website sets no cookies of its own and uses no analytics, advertising or tracking services. There is nothing here for you to consent to or opt out of. Netlify may log basic technical information such as IP address as part of serving and protecting the site.

How long we keep it

• Enquiries that do not proceed: up to 12 months, then deleted.
• Completed purchases: 6 years after the relationship ends, which covers the limitation period for contract claims.
• Anti-money-laundering and identity records: 5 years from the end of the business relationship, as the regulations require.
• Accounting records: 6 years, as HMRC requires.

How we protect it

Access is limited to the people who need it. Our systems are password-protected and encrypted in transit, identity documents are stored securely and deleted once the relevant retention period ends, and paper records encountered during a clearance are returned to the family or securely destroyed on their instruction.

Your rights

Under UK data protection law you have the right to ask us for a copy of the information we hold about you; to have inaccurate information corrected; to have information erased where we no longer need it; to restrict or object to how we use it, including where we rely on legitimate interests; to receive information you gave us in a portable format; and to withdraw consent where we relied on it, without affecting anything done beforehand. Some of these rights are qualified — where the law requires us to keep a record, we cannot delete it — and we will explain if that applies.

Complaints

If you are unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Information Commissioner’s Office at ico.org.uk, by calling 0303 123 1113, or by writing to Wycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF.

Changes to this notice

We review this notice periodically and will post any changes on this page. If a change materially affects how we use your information, we will tell you directly.
